A lien is the claim made against a property towards repayment of loans. They are categorized as involuntary liens and voluntary liens. A voluntary lien is a deed of trust lien or a mortgage lien. For instance, when you buy property, the lender retains the claim on the property until you pay the mortgage in full. An involuntary lien is what happens when there is legal action.

There are several types of liens, such as the bail bond lien, child support payment, code enforcement lien, corporate franchise lien, federal judgment lien, federal tax lien, homeowners’ association lien, judgment lien, marital support lien, mechanic’s lien, mortgage and deed of trust lien, municipal lien, public defender lien, real property tax lien, state inheritance tax lien, welfare lien etc.

You will be able to get detailed information about liens from the federal, state or local sources. Although, depending on the state or the local agency, the names may differ, but by and large all the information in different states can be accessed from the circuit court office, county clerk’s office and the country recorder’s office.

When searching for information on liens, search for judgment liens, federal tax liens, property tax liens etc. Also look for land sales contracts, contracts for deed etc.

It would also help to look for “lis penden,” which is the notice filed to warn people that a certain real property is under litigation.

Check out the municipal clerk’s records and the United States court records. By checking all of the above, you would understand how liens work and everything else that you should know. A little knowledge goes a long way in ensuring you tackle things properly and never get into trouble.
